David McDowell and Nancy Thomas authored an article for Law360 where they share five things in-house counsel can do when facing data breach class actions.
First on the list is creating a strong foundation. “Depending on the nature and scope of the breach, companies can expect dozens if not hundreds of class actions in the days and weeks after announcing a breach,” the authors wrote. “This flurry of action can seem like chaos of the worst kind – the kind with no end in sight. At this early stage, companies need outside counsel who can scale up and handle dozens or hundreds of lawsuits until the filings slow and steer the lawsuits into a manageable posture.”
