Privacy Litigation 2020 Year in Review: Data Breach Litigation

2020: the year that will be remembered for privacy litigation. Well, OK, maybe not. But there were many developments in privacy litigation. In part one of our Privacy Litigation Year in Review series, we focus on data breach litigation. Cybersecurity is on the short list of major risks facing companies. And when a security incident happens, class actions usually follow. Although data breach class actions are not new, we continue to see increases in the number of cases filed, evolving theories from plaintiffs’ counsel, fierce battles over production of cybersecurity firm and consultant reports, and the templates that have developed for settlement.
